These Terms of Service ("Terms") govern your access to and use of Title Clear™, operated by Title Clear AI, LLC ("Company", "we", "us", or "our"). By creating an account or using our services, you agree to be bound by these Terms.

1. Description of Service

Title Clear™ is an AI-powered document analysis platform designed to assist licensed Florida title professionals with title clearance workflows. The platform analyzes title commitments, purchase and sale contracts, and related documents to generate clearance checklists and correspondence drafts.

2. AI-Generated Content Disclaimer

You acknowledge and agree that:

• All AI-generated checklists, analyses, and correspondence drafts must be reviewed and verified by a licensed title professional before use.
• Title Clear AI, LLC is not a law firm and does not provide legal advice.
• The Company is not responsible for errors, omissions, or inaccuracies in AI-generated content.
• You are solely responsible for verifying all requirements with your underwriter and applicable Florida law before closing any transaction.
• No attorney-client relationship is created by use of this service.

3. Eligibility and Account Registration

You must be at least 18 years old and a licensed or authorized title professional to use this service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload documents containing personally identifiable information beyond what is necessary for title clearance.
• Attempt to reverse engineer, copy, or replicate any part of the platform.
• Share your account credentials with unauthorized third parties.
• Use the service to process documents on behalf of clients without appropriate authorization.

5. Subscription and Payment

Title Clear™ offers subscription plans billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

6. Data and Privacy

Your use of Title Clear™ is also governed by our Privacy Policy. You retain ownership of all documents you upload. We do not sell your data to third parties. Documents are stored securely and are only accessible by you and authorized members of your account.

7. Intellectual Property

Title Clear™, its logo, and all related technology, software, and content are the exclusive property of Title Clear AI, LLC. You may not copy, modify, distribute, or create derivative works without express written permission. The AI models, prompts, workflows, and Florida-specific legal knowledge embedded in the platform are proprietary trade secrets of Title Clear AI, LLC.

8. Limitation of Liability

Our total liability to you for any claims arising from use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Title Clear AI, LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any applicable law or third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time from your account settings. Upon termination, your access to the service will cease and your data will be retained for 30 days before permanent deletion.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of Miami-Dade County, Florida.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the service after changes constitutes acceptance of the new Terms.
